How UAE end-of-service gratuity works
End-of-service benefit (EOSB), commonly called “gratuity”, is a lump-sum payment a UAE private-sector employer must pay an employee when their employment ends, provided the employee has completed at least one year of continuous service.
Under Federal Decree-Law 33 of 2021 (effective 2 February 2022) the calculation is:
- 21 days of basic pay for each of the first five years of service.
- 30 days of basic pay for each additional year beyond five.
- Total gratuity is capped at two years of basic salary.
- Basic salary only — housing, transport, and other allowances are excluded.
- Termination for cause under Article 44 disqualifies the employee from gratuity.

How is end-of-service gratuity calculated in the UAE?+
Under Federal Decree-Law 33 of 2021, gratuity is based on the employee's basic salary (excluding allowances). For the first five years of service the employee earns 21 days of basic pay per year; for each year after that they earn 30 days of basic pay per year. Total gratuity is capped at two years of basic salary.
Is gratuity calculated on basic salary or total salary?+
Only basic salary. Housing, transport, and other allowances are excluded from the EOSB calculation under the federal labor law.
Do employees on a probation get end-of-service gratuity?+
No. Gratuity entitlement begins after one year of continuous service. Termination during probation does not entitle the employee to gratuity.
Does the type of termination affect the gratuity amount?+
Yes for fixed-term contracts that pre-date Decree-Law 33 — older rules reduced gratuity if the employee resigned before completing certain service thresholds. Under the current law (post-Feb 2022) gratuity is calculated the same way regardless of who terminates, as long as the employee has at least one year of service and was not dismissed for cause under Article 44.
Is unpaid leave counted toward the gratuity calculation?+
No. Periods of unpaid leave or unauthorised absence are excluded from the years of service used to compute gratuity.
What if my employer hasn't paid my gratuity?+
End-of-service entitlements must be paid within 14 days of the end of the employment relationship. If they are not, the employee can file a complaint with the Ministry of Human Resources and Emiratisation (MoHRE).
